Geosynthetic cap installation, leachate collection, HDPE liner systems. EPA CERCLA and RCRA Subtitle C permitted.
Class C — Drainage Recontouring

SMCRA bond release requires documented performance at three regulatory thresholds. Below is our aggregate release record across 318 completed permits.
Contemporaneous Reclamation
Earthwork & Drainage Completion
- Final grading to approved contour (±2 ft LIDAR tolerance)
- Sediment pond removal and drainage course restoration
- APDES monitoring: 12-month clean discharge record
- Geotechnical stability certification (factor of safety ≥1.5)
- OSM/state regulatory inspection and sign-off
Phase I accounts for 60% of bond liability. Our average Phase I submittal is approved on first review in 87% of cases.
Vegetation Establishment
Seeding, Monitoring & Productivity Proof
- Native seed mix installation per NRCS-approved specification
- Minimum 70% ground cover two growing seasons post-seeding
- Species diversity count: ≥18 native species per plot
- Soil productivity equivalence to pre-disturbance baseline
- Annual photo documentation and biomass sampling
We maintain a 97% Phase II approval rate. Seed mix selection is site-specific — no single formula applied across all contracts.
Full Bond Release
Liability Extinguishment & Site Transfer
- Five-year post-seeding vegetation monitoring complete
- Water quality parameters within pre-mining baseline (±10%)
- Absence of instability, erosion, or off-site discharge
- Final OSM/state closeout inspection passed
- Bond exoneration letter issued to permittee
Complete bond exoneration eliminates ongoing financial assurance obligations. Our clients have recovered $840M in aggregate bond liability since 2008.
